Changes to Court Proceedings

It has recently been announced that from 1st November 2021, the document entitled ‘Overall Arrangements for Possession Proceedings’ is no longer to be viewed as governing or guiding principles. One of the main things this document did was introduce non-attended hearings prior to a substantial attended hearing. This will no longer be required moving forwards.


We are awaiting a urgent updated practice Direction to advise us of updates to Practice Direction 55C – this being about the temporary Coronavirus measures. It Is assumed that all current measures in place for possession proceedings will continue for all claims brought on or before 30th November 2021 with a transitional phase for all claims brought after this date.
