Government plans for a Code of Practice for the commercial sector over rental payments

On 29 May, the government announced that it had set up a working group with the commercial rental sector.  The purpose of the working group is to develop a code of practice in respect of rental payments during the Covid-19 crisis.

The aims of the code are as follows:

  1. To encourage fair and transparent discussions between landlord and their tenants over rental payments during the pandemic, provide guidance on arrears payments and the treatment of those who are subletting and suppliers
  2. To be a temporary measure

The Code should be available by the next quarter payment date (24 June 2020).  Initially it will be advisory but the government will consider making the Code mandatory if necessary.

The above is an additional measure to the ones already put in place by the government, for example a ban on the landlord’s ability to forfeit a lease due to non-payment of rent, which we have already reported on.
